NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS PROMOTION. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ONLY ONE (1) ENTRY WILL BE ACCEPTED PER PERSON AND/OR EMAIL ADDRESS PER CONTEST. ENTRIES THAT DO NOT MEET THE REQUIREMENTS SPECIFIED BELOW WILL BE DISQUALIFIED AND WILL NOT BE JUDGED.
ELIGIBILITY: PROMOTION IS OPEN ONLY TO LEGAL FEMALE RESIDENTS OF THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA (THE “ELIGIBILITY AREA”) SIXTEEN (16) YEARS OF AGE OR OLDER AS OF THE DATE OF THEIR ENTRY. The Promotion is sponsored by Shabby Chic Brands, LLC and Entitled Brands, Inc. (“Sponsors”). Employees and their families (defined as parent, child, sibling and spouses) of the Sponsors, their affiliates, subsidiaries, parent companies and agencies (collectively, the “Promotion Parties”) and those living in the household of same (whether related or not) are not eligible to enter or win. By entering this Promotion, entrants agree to abide by all terms and conditions of these Official Rules. The laws of the United States apply to and govern this Promotion and any claims must be raised and resolved in the federal or state courts located in Los Angeles, CA, United States. All federal, state and local rules and regulations apply. Void in Puerto Rico, all U.S. territories and possessions and overseas military installations and where prohibited or restricted by law. A prize won by an individual considered a minor in his or her legal jurisdiction of residency (“Minor”) will be awarded in the name of the Minor’s parent or legal guardian.
HOW TO ENTER: During the entry period of 5/7/12 through 5/12/12 at 11:59 pm PT (“Entry Period”), you may enter via the Internet by visiting the website at www.girlsguideto.com (the “Promotion Site”); and following the on-screen instructions for entry in the Promotion including signing onto Facebook and providing your response (“Response”) to the specific Contest question asked. By completing the foregoing, you will automatically receive one (1) entry into the specific Contest subject to the terms of these Official Rules, (the provision of information and Response collectively referred to as the “Entry”).
IMPORTANT NOTE: When submitting an entry, you cannot submit it anonymously. Doing so will make the submission invalid.
Sponsors may, in their sole discretion, post any one or more of the Entries on the Promotion Site for viewing by the public. With respect to each submitted Entry, the submitting entrant understands, acknowledges and agrees that Sponsors are under no obligation whatsoever to post any Entry on the Promotion Site or to continue to display on the Promotion Site any Entry previously posted, and/or otherwise to use the Entry as permitted pursuant to these Official Rules.
In addition to any other requirements set forth in these Official Rules, in order to be deemed eligible for participation, each Entry and/or the entrant submitting it must meet the following conditions and restrictions:
- The Entry must not defame or invade the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights or that constitute copyright infringement.
- The entrant should own or otherwise have the right to submit the Entry as contemplated hereunder, subject to the rights granted by entrant hereunder. - The Entry must not contain any content that is sexually explicit, sexually suggestive, offensive, illegal, pornographic or obscene or that is in bad taste or is otherwise objectionable to Sponsors, as determined by Sponsors in their sole and exclusive discretion.
- The Entry must not disparage Sponsors or any other person or party affiliated with the Promotion and administration of this Promotion.
- The Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
- The Entry must not contain corrupted files, viruses, or any other similar software files, the intent of which is to damage the operation of another’s computer.
- The Entry must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Entry is created.
Uploading the Entry constitutes entrant’s consent to grant Sponsors a royalty-free, irrevocable, perpetual, non-exclusive, worldwide, unrestricted and transferable license to use, edit, alter, copy, reproduce, modify, disclose, publish, remove, create derivative works from, distribute, exhibit, display or otherwise exploit such Entry in whole or in part, and to incorporate it into other works, in any form, media or technology now known or later developed, for any purpose whatsoever including, without limitation, for advertising, promotion or publicity purposes without any additional compensation or notification to entrant.
LIMITATIONS ON LIABILITY: Sponsors shall not be liable to a prize winner or any other person for failure to supply a prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsors’ sole control.
Acceptance of a prize constitutes permission (except where prohibited by law) for Sponsors and their designees to use the Contest Winner’s name, address (city and state), likeness, voice, statements, Entry (and any version thereof) and any other personal characteristics for any purpose, including without limitation advertising, promotion and publicity purposes worldwide in perpetuity, in any medium or format now known or hereafter created, without additional compensation, notification, permission or limitation, and the prize winner hereby releases Sponsors and their designees from any liability with respect to such use.
By entering this Promotion, entrants agree that Sponsors shall not be liable for personal injuries, death, dismemberment, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Promotion, or from acceptance of or use or inability to use a prize or parts thereof, including without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, dismemberment, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Each Contest Winner: (a) releases the Sponsors from any and all liability and responsibility with respect to a prize (including any property loss, damage, personal injury or death); and (b) acknowledges the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to a prize.
GENERAL: If for any reason this Promotion or part thereof is not capable of running as planned, or if this Promotion or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Promotion and processing of Entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion or any part thereof, the Sponsors reserve the right, in Sponsors’ sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify or suspend this Promotion or any portion thereof In the event this Promotion is cancelled before the scheduled conclusion of the Promotion or any portion thereof, Sponsors reserve the right to proceed to judge the eligible entries received (as detailed above) prior to the time of the action or event warranting such cancellation and award the applicable prizes. Where a dispute arises about who submitted an entry of any kind in the Promotion, the entry will be deemed submitted by the authorized account holder of Facebook account entered. The “authorized account holder” is deemed the natural person who has registered with Facebook for the user name associated with the submitted entry. A potential winner may be requested to provide the Sponsors with proof that the potential prize winner is the authorized account holder of the Facebook account associated with the winning entry and that all eligibility requirements are met.
NOTE: Entry must be made by the entrant, only at the Promotion Site. Entries made by any other individual or any entity, and/or originating at any other Internet web site or email address, including but not limited to commercial Contest subscription notification and/or entering service sites, will be declared invalid and disqualified for this Promotion.
